Terms

The rules for using Brayer, in plain sentences.

This is the agreement we would want to sign ourselves. It is not legal advice, and a lawyer has not reviewed it yet.

01The short version

You own what you make. We run the exchange.

You own your prints, your photos, and your colophons, always. Organizers are responsible for the exchanges they run. Be decent to the rest of your roster. We can update these terms, and we’ll date them at the top when we do.

02Your account

One account, kept accurate.

Register with an email you actually read, and keep your mailing address current if you’re taking part in an exchange, so prints reach you and the roster stays honest. You’re responsible for what you post under your account, including messages to your exchange.

03Exchanges

Organizers run their roster; we run the platform.

An organizer is responsible for the exchange they create: who’s on the roster, the deadlines they set, and handling participants’ mailing addresses with care. Brayer is not a party to shipping prints or paying fees between participants; that happens directly between the people in the exchange.

A 5% fee applies to paid exchanges, once fee collection is live. Free exchanges, which is every exchange today, aren’t charged anything.

04Your content

You own it. We show it to your exchange.

You own your prints, photos, and colophons, in full. By submitting to an exchange, you grant Brayer only what’s needed to show that content to the members of that exchange: displaying your submission photo on the roster, and including your work in the colophon.

05Acceptable use

No harassment, no scraping, no selling on the message board.

Don’t harass or threaten anyone in an exchange. Don’t scrape rosters or collect other participants’ contact details for anything outside the exchange itself. The message board is for organizing the exchange, not for selling prints, supplies, or anything else.

06The app

Purchased through the App Store, under Apple's terms.

When it ships, the iPad app is purchased through the App Store and governed by Apple’s standard end-user terms in addition to these. Refunds for App Store purchases go through Apple, not Brayer directly.

07Liability

We're not liable for what happens between participants.

Brayer is provided as it stands, without a guarantee that it will be free of errors or interruptions. We’re not liable for lost, damaged, or undelivered prints, for disputes between exchange participants, or for indirect losses arising from using the site. Our liability to you, if any, is limited to what you’ve paid us in the twelve months before the claim.

08Changes

We'll date it when it changes.

If these terms change in a way that matters, we’ll update the date at the top and describe the change here.
